Welcome to chriscarmichael.org (the “Site”), operated by Chris Carmichael Building Common Ground (“Campaign,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site and any content, functionality, and services offered on or through the Site.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility and Use of the Site
• You may use the Site only for lawful purposes and in accordance with these Terms.
• You agree not to use the Site:
o In any way that violates applicable federal, state, or local laws or regulations.
o To impersonate any person or entity or misrepresent your affiliation with any person or entity.
o To transmit any unlawful, threatening, defamatory, obscene, or otherwise objectionable material.
o To attempt to interfere with the proper working of the Site, including by introducing viruses, malware, or other harmful code.
We reserve the right to suspend or terminate your access to the Site for any violation of these Terms.

3. Intellectual Property Rights

• You may access and use the Site and Content for your personal, non‑commercial use only.
• You may print or download a reasonable number of pages from the Site for personal reference, provided you do not remove any copyright, trademark, or other proprietary notices.
• You may not:
o Modify copies of any materials from the Site.
o Use any Content separately from its accompanying text or context.
o Use any Content for commercial purposes or for any political campaign other than Chris Carmichael Building Common Ground without our prior written consent.
All trademarks, logos, and service marks displayed on the Site are the property of the Campaign or third parties. Nothing on the Site grants any license or right to use such marks without prior written permission.
4. User Submissions and Interactive Features
The Site may offer forms, surveys, comment features, or other ways for you to submit information, such as stories, questions, or feedback (“User Submissions”).
By submitting any User Submissions, you:
• Represent and warrant that the information you provide is accurate to the best of your knowledge and that you have the right to submit it.
• Grant the Campaign a non‑exclusive, royalty‑free, worldwide, perpetual, irrevocable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for campaign‑related purposes, in any media now known or later developed.
• Understand that User Submissions are not confidential, and we may use them in aggregated or de‑identified form in campaign materials, reports, or communications.
We reserve the right (but are not obligated) to review, edit, or remove any User Submissions we, in our sole discretion, believe violate these Terms or are otherwise inappropriate.
5. Donations and Third‑Party Services
The Site may link to or embed services provided by third parties, including:
• ActBlue for processing contributions.
• Mailchimp for email sign‑ups and communications.
• Meta (Facebook and Instagram) and X (formerly Twitter) for social media engagement and advertising.
• Google and associated apps for storage and operational uses.
Your use of these third‑party services is governed by their own terms and privacy policies, not these Terms. We are not responsible for the content, security, or practices of third‑party sites or services.
We are required to comply with federal and state campaign finance laws. Contributions made through ActBlue or other platforms are subject to applicable regulations and reporting requirements.
6. Messaging Terms & Conditions
6.1 General
When you opt-in to the service, we will send you a message to confirm your signup.
By opting into messages, you agree to receive recurring automated marketing and informational text messages from Chris Carmichael for Congress. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.
Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Chris Carmichael for Congress. Chris Carmichael for Congress reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Chris Carmichael for Congress also reserves the right to change the short code or phone number or alphanumeric sender where messages are sent
Your usual message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your mobile provider. Your mobile provider is not liable for delayed or undelivered messages.
Your consent to receive marketing messages is not a condition of purchase.
6.2 Carriers
Carriers are not liable for delayed or undelivered messages.
6.3 Cancellation
Messages will provide instructions to unsubscribe either by texting STOP or through an included link. After you unsubscribe, we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Chris Carmichael for Congress again, just sign up as you did the first time and Chris Carmichael for Congress will start sending messages to you again.
6.4 Info
For support regarding our services, email us at info@chriscarmichael.org or, if supported, text \"HELP\" to our messages at any time and we will respond with instructions on how to unsubscribe. If we include a link in messages we send you from Chris Carmichael for Congress, you may also access instructions on how to unsubscribe and our company information by following that link.
6.5 Transfer of Number
You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply \"STOP\" from the original number, unsubscribe using the link included in our messages (if one is provided), or notify us of your old number at info@chriscarmichael.org. The duty to inform us based on the above events is a condition of using this service to receive messages.

6.7 Messaging Terms Changes
We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. If you do not agree to a change to these Messaging Terms, you should cancel your enrollment with our messaging program. Your continued enrollment following such changes shall constitute your acceptance of such changes.

Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to our collection and use of your information as described in the Privacy Policy.

We do not warrant that:
• The Site will be uninterrupted, secure, or error‑free.
• Defects will be corrected.
• The Site or the server that makes it available are free of viruses or other harmful components.
• The information on the Site is accurate, complete, or up‑to‑date at all times.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE CAMPAIGN, CHRIS CARMICHAEL, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT, EVEN IF FORESEEABLE.
To the extent any liability is found despite the above, the total liability of the Campaign to you for any and all claims arising out of or related to the Site shall not exceed one hundred U.S. dollars (US $100) in the aggregate.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Campaign, Chris Carmichael, and their officers, directors, employees, volunteers, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:
• Your violation of these Terms.
• Your use of the Site or Content other than as expressly authorized.
• Your User Submissions, including any content that infringes or violates the rights of any third party or any applicable law.
12. Changes to the Site and to these Terms
We may update or change the Site, Content, or these Terms from time to time.
• If we change these Terms, we will update the “Last updated” date at the top of this page.
• Your continued use of the Site after any changes are posted means you accept the revised Terms.
We may also withdraw or modify the Site (or any portion of it) without notice and will not be liable if all or any part of the Site is unavailable at any time or for any period.

We reserve the right, in our sole discretion, to suspend or terminate your access to all or part of the Site for any reason, including violation of these Terms.

14. Governing Law and Jurisdiction
These Terms and your use of the Site are governed by the laws of the State of Kansas and applicable federal law, without regard to conflict‑of‑law principles.
Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Kansas, and you consent to the personal jurisdiction of such courts.
15. Miscellaneous
• Entire Agreement – These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Campaign regarding the Site and supersede any prior understandings or agreements on this subject.
• Severability – If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• No Waiver – Our failure to enforce any provision of these Terms shall not be considered a waiver of our rights.
• Assignment – You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of any organizational transition or as otherwise permitted by law.
